In May 2025, the Michigan Department of Licensing and Regulatory Affairs (LARA) adopted the 2021 International Energy Conservation Code (IECC) with minimal amendments. Originally, this code was set to take effect for residential building permits issued on or after August 29, 2025.

 

However, due to a legal challenge filed by the Home Builders Association of Michigan and the Michigan Manufactured Housing Association, the implementation of the 2021 IECC has been put on hold. The lawsuit argues that the adopted code does not meet Michigan’s legal requirements for long-term cost effectiveness, among other concerns.

 

As a result, LARA has delayed the rollout of the new code until the legal proceedings are resolved. At this time, no official timeline has been announced. The delay could last several months or extend over a year, depending on the outcome of the case.

Several potential outcomes are possible:

 

  • The 2021 IECC may move forward and be implemented as originally adopted.
  • Additional amendments may be made to the 2021 version.
  • The state may decide to adopt the newer 2024 IECC instead.

While the updated code is not currently in effect, we know that many builders are looking for clarity and guidance.
